These Terms & Conditions (“Terms”) govern your use of our website lumisha.in and any services provided by Lumisha India Private Limited / Lumisha LLC (“Lumisha”, “we”, “us”, or “our”). By accessing our site or using our services, you agree to be bound by these Terms.

1. Services

  • We offer professional services such as virtual assistance, customer support, lead generation, appointment scheduling, etc. Services may be provided on a project basis, hourly basis, or subscription basis as per agreement.

  • We agree on service scope, deliverables, timelines, and fees before commencement.

2. Payment

  • Payment terms will be specified in the service agreement or invoice. Payment may be required upfront, weekly, or on milestones.

  • Fees not paid by due date may incur interest or late fees.

  • We reserve the right to pause services if payment is overdue.

3. Customer Obligations

  • Provide necessary access, information, materials, approvals, and feedback required for service delivery.

  • Respond in a timely manner to our queries; delays from your side may delay delivery.

  • Respect intellectual property rights, confidentiality, and usage guidelines of materials provided by us.

4. Intellectual Property

  • Unless otherwise agreed in writing, all original materials and deliverables created by Lumisha for you will remain Lumisha’s property until full payment, after which rights are transferred to you as agreed.

  • We retain the right to use non-confidential work samples for portfolio, promotional, or demonstration purposes unless you request otherwise in writing.

5. Confidentiality

  • Both parties agree to treat confidential any information disclosed in connection with services that is marked confidential or ought reasonably to be known as such.

  • We will not disclose your confidential information to third parties except as necessary to fulfill the service.

6. Limitation of Liability

  • Our liability is limited to the fees you have paid for the services in question.

  • We are not liable for indirect, incidental, special, or consequential losses (including loss of profits, data, business) arising out of or in connection with services.

  • Services may be interrupted due to forces beyond our control (internet, system failures, acts of God). We are not liable in such events.

7. Cancellation & Refunds

  • Cancellation & Refunds are governed by our Cancellation & Refunds Policy (see that page).

8. Termination

  • Either party may terminate the service agreement if the other breaches major obligations and fails to remedy the breach within 14 days of written notice.

  • Termination will not affect accrued rights or obligations up to the date of termination.

9. Governing Law & Dispute Resolution

  • These Terms shall be governed by the laws of India / West Bengal (adjusted to your jurisdiction).

  • Any dispute arising under or in connection with these Terms will be submitted to the courts of Kolkata, West Bengal, unless otherwise agreed.

10. Changes to Terms

  • We may change these Terms from time to time. Updated versions will be posted to lumisha.in/terms‑and‑conditions with a revised last updated date. Your continued use of services constitutes acceptance of the changes.
